Constitutional History of Canada

The Constitution of Canada is the country’s governing legal framework. It defines the powers of the executive branches of government and of the legislatures at both the federaland provincial levels. Canada’s Constitution is not one legal document. It is a complex mix of statutes, orders, British and Canadian court decisions, and generally accepted practices known as constitutional conventions. The Constitution has been in constant evolution from colonial times to the present day. The story of the Constitution is the story of Canada itself. It reflects the shifting legal, social and politicalpressures facing Canadians, as well as their choices as a society.

Indigenous Political Organization and Activism in Canada

Political activism among Indigenous people in Canada since the late 19th century has largely reflected attempts to organize political associations beyond the band level to pursue common interests. In the wake of persistent criticism of the federal government’s proposed “White Paper” policy (1969), major Indigenous organizations, most notably the Assembly of First Nations, gained political recognition and became established players on the national scene. These organizations were joined in 2012 by the national movement Idle No More.

This article describes Indigenous political organization as it relates to Canadian federal, provincial or territorial political bodies, not the political structures of specific Indigenous communities, which often predate interaction with Europeans and subsequent colonial infrastructure.

Politics on Prince Edward Island

Prince Edward Island has a minority Progressive Conservative government, elected 23 April 2019. The premier is Dennis King and the lieutenant-governor is Antoinette Perry. Peter Bevan-Baker leads the only Green Party opposition in Canada. Until 2019, only the Liberals or Progressive Conservatives had ever governed or formed the official opposition. The dominance of these two parties has led some to call PEI the purest two-party system in the country. Yet PEI has seen a number of electoral firsts: Aubin-Edmond Arsenault was Canada’s first Acadian premier; Joe Ghiz was Canada’s first premier of non-European descent; and Catherine Callbeck was the first woman in Canada to win an election as premier.

Charlottetown Conference

The Charlottetown Conference set Confederation in motion. It was held from 1–9 September 1864 in Charlottetown, with additional meetings the following week in Halifax, Saint John and Fredericton. The conference was organized by delegates from New BrunswickNova Scotia and Prince Edward Island to discuss the union of their three provinces. They were persuaded by a contingent from the Province of Canada, who were not originally on the guest list, to work toward the union of all the British North American colonies. The Charlottetown Conference was followed by the Quebec Conference (10–27 October 1864) and the London Conference (December 1866–March 1867). They culminated in Confederation on 1 July 1867.

Language Policy in Canada

Language policy is comprised of a body of theory, principles, laws, programs and measures designed to manage one or more languages in a country. In monolingual societies, language policy is usually concerned with promoting an approved, standardized grammar of the common language. In bilingual or multilingual societies, it is intended to manage situations in which two or more languages are in contact and/or conflict, and to enhance the use and status of certain languages over others. Language policy in Canada has been designed to manage historical relationships among multiple languages – notably FrenchEnglish and Indigenous languages - and their various communities. While it has evolved over time, Canadian language policy has not always been marked by positive or just measures.

Editorial: Newfoundland’s Contribution to the Patriation of the Constitution

In the decades since 1982, politicians and the media have recounted the same story about the patriation of Canada’s constitution and the adoption of the Charter of Rights and Freedoms. Most of the credit in this version goes to Prime Minister Pierre Trudeau. Three others are credited with breaking an impasse in the 1981 negotiations: federal justice minister Jean Chrétien, Saskatchewan attorney general Roy Romanow, and Ontario attorney general Roy McMurtry. But in his memoirs, former Newfoundland PremierBrian Peckford argues that the key intervention in the patriation process came from Peckford and the members of the Newfoundland delegation.

Confederation's Opponents

Opposition to Confederation has existed since a union of British North Americancolonies was first proposed in the late 1840s. In the eastern parts of the country, opponents generally feared that Confederation would strip power from the provincesand hand it to the federal government; or that it would lead to higher taxes and military conscription. Many of these opponents ultimately gave up and even served in the Canadian government. In the West, Indigenous peoples in the Red River Colonywere never asked if they wanted to join Confederation. Fearing for their culture and land rights under Canadian control, they mounted a five-month insurgency against the government. Many Quebec nationalistshave long sought to separate from Confederation, either through the extreme measures of the Front de libération du Québec (FLQ), or through referenda in 1980 and 1995.

Senate of Canada

The Senate is the Upper House of Canada’s Parliament. Its 105 members are appointed and hold their seats until age 75. The Senate’s purpose is to consider and revise legislation; investigate national issues; and most crucially according to the Constitution, give the regions of Canada an equal voice in Parliament. The Senate is a controversial institution. It has long been regarded by many Canadians as a place of unfair patronage and privilege. An unresolved debate continues about whether it should be reformed into an elected body accountable to the voters, or abolished.
